These Supplemental Terms are applicable to the use of the Plivo Services solely to the extent that you use the identified Service. These Supplemental Terms are incorporated as part of Plivo’s Acceptable Use Policy (“AUP’’), available at https://www.plivo.com/aup/. You acknowledge that you have read, understood, and agree to be bound by these Supplemental Terms, in addition to all the terms of our terms of service, AUP and the privacy policy, as modified from time to time.

WhatsApp Business Solutions

As a customer, you acknowledge that Plivo serves as an authorized reseller and provider of business solutions for WhatsApp Business Solutions (“WhatsApp Services”). When you purchase WhatsApp Services through Plivo, you understand that your usage of WhatsApp Services and/or the WhatsApp platform constitutes a separate agreement with Meta Platforms Inc., or its affiliates, as applicable. Your use of the WhatsApp Services is subject to the WhatsApp Business Solution Terms , Meta Terms for Whatsapp Business, Meta Hosting Terms for Cloud API, Facebook Terms of Service, Meta Commercial Terms, WhatsApp Business Messaging Policy, Beta Product Testing Terms and other relevant WhatsApp terms and policies (collectively referred to as “WhatsApp Terms”). 

You accept that these terms and policies may change over time, and you bear sole responsibility for complying with the current WhatsApp Terms. Your continued use of the Services signifies your acceptance of any modified or updated terms. You also acknowledge that WhatsApp or Plivo may, at any time and without notice, suspend or terminate your account or service use.

You commit to always comply with the WhatsApp Terms relevant to your use of the WhatsApp Services. Plivo provides the WhatsApp Services on an “as is” and “where is” basis, disclaiming any liability for losses, damages, or claims related to your use of the WhatsApp Services and/or platform, or any third-party services or products. Plivo will not be liable for any service interruptions or issues arising from your actions or those of your end users. Plivo expressly disclaims any warranties, whether express or implied, regarding the compliance of third-party products or services with the Health Insurance Portability and Accountability Act (HIPAA) or any related regulations. It is your responsibility to ensure compliance with HIPAA and other applicable laws for any third-party products or services you use.

AS A CUSTOMER, YOU ARE EXPRESSLY PROHIBITED FROM RESELLING, REDISTRIBUTING, SUBLICENSING, OR PROVIDING THIRD-PARTY ACCESS TO PLIVO’S WHATSAPP BUSINESS SERVICES.

To use WhatsApp Business Services for your brand, you should create a WhatsApp Business account (WABA) through the Plivo Console and consult Plivo’s WhatsApp Self Sign-up guide.

Independent Software Vendors (ISVs) interested in reselling WhatsApp Services must register as a ‘Tech Provider’ and comply with the conditions specified in the Tech provider terms.

WhatsApp Business Calling API

You agree and acknowledge that the WhatsApp Business Calling API feature (the “WhatsApp Calling Program”) is not yet generally available and is provided solely as a Beta Offering at Meta’s discretion. Use of the WhatsApp Calling Program is subject to the Meta Beta Product Testing Terms.

You further agree and acknowledge that participation in the WhatsApp Calling Program is limited to specific use cases designated by Meta and is subject to Meta’s review and approval, each in its sole discretion. The Program is intended exclusively to support VoIP-to-VoIP calling functionality.

You agree to obtain opt-in consent from end users prior to initiating any calls, in accordance with the requirements applicable to WhatsApp messages under the WhatsApp Business Messaging Policy and Plivo ToS, including any updates to that policy during the Program's testing period.

For clarity, any use of the WhatsApp Business Solution (as defined in the Meta Terms for WhatsApp Business) in connection with the Program is subject to all applicable fees and charges, in accordance with the Meta Terms for WhatsApp Business and/or the Plivo Terms of Service.
